Terms of Service

Turq · Last updated: 9 October 2026 · Version 1.13

The legally binding version is the German version ("Nutzungsbedingungen"). This English translation is provided for convenience; in case of discrepancies, the German version prevails.

1. Scope and provider

1.1 These Terms of Service apply to the use of the mobile application "Turq" (the "App") and the associated services.

1.2 The provider and contracting party is: Tim Gröschke (sole proprietor), Berolinastr. 6, 10178 Berlin, Germany, contact: support@turq.app (the "provider", "we").

1.3 These Terms of Service apply; the terms of the app stores apply in addition in accordance with Section 6.4. Any conflicting terms of the user are rejected.

1.4 Point of contact: The single point of contact for users and for the authorities of the Member States, the European Commission, and the European Board for Digital Services (Articles 11 and 12 of Regulation (EU) 2022/2065, "Digital Services Act") is support@turq.app. Communication is possible in German and English and does not take place solely by automated means.

2. Description of services

2.1 The App assists with managing aquariums, including recording water parameters and measurements, planning recurring maintenance tasks, documenting inhabitants and diseases, and the AI-based assistant "Qualy". In addition, values from files uploaded by the user (e.g. reports, photos, or spreadsheets) may be adopted by means of AI-based extraction; likewise, inhabitants may be recorded with AI support from a text, a photo of a list, or photos of the animals, with the AI suggesting the species. The extracted values and suggested inhabitants are shown to the user for review before they are adopted; a species suggestion is not a reliable identification.

2.2 The specific scope of functions depends on the version provided and the selected usage tier (see Section 5). The provider continuously develops the App and may add features. It may change or discontinue features insofar as this is reasonable for the user and there is a valid reason for doing so, in particular: security or data protection requirements, changes in the legal situation or requirements imposed by authorities, the discontinuation or modification of third-party services (e.g. of an AI service provider or an app store), technical progress, or a significant change in operating costs. For paid tiers, Section 5.2 applies in addition. The user's statutory rights in the event of changes to digital products, in particular the right to terminate the contract under Section 327r(3) BGB, remain unaffected.

2.3 Not a substitute for professional advice. Content of the App and outputs of the AI-based functions — in particular the AI assistant Qualy and automated evaluations (e.g. the AI-based analysis of water parameters) — serve informational and orientation purposes. They do not constitute animal, veterinary, or health-related advice and do not replace the assessment of a qualified person (e.g. a veterinarian). Decisions, in particular regarding illness or treatment questions, are made by the user on their own responsibility.

2.4 User responsibility and duty to verify. The App is a documentation, calculation, and reminder tool. It does not monitor the aquarium autonomously, does not measure any values, and does not interact with aquarium equipment. All information provided — in particular dosing quantities, target ranges, evaluations, and reminders — is based on the data entered by the user, the settings they have selected, and the general reference values provided by the provider (Section 2.6). The user is responsible for checking the plausibility of the displayed results before taking any action, in particular before adding substances to the aquarium. Care of the aquarium and responsibility for the animals living in it remain with the user.

2.5 Calculations. Calculated values (e.g. dosing quantities, remaining quantities, consumption forecasts) are computational aids based on the product and aquarium data entered. They do not account for the actual conditions in the individual tank. The specifications of the respective manufacturer of a product take precedence over the information provided by the App.

2.6 Reference values and target ranges. For water parameters, the App stores general reference values and target ranges derived from them. These are orientation values for typical tanks of a given category, derived from aquarium literature and common practice — they are not target values tailored to the individual aquarium. Stocking, the age and cycling stage of the tank, the maintenance approach and feeding, as well as the products and testing methods used, may make deviating values appropriate. The graphical or colour-coded classification of a measurement (e.g. as “within range” or “out of range”) is a simplified representation of this comparison and does not constitute a professional assessment of the situation in the aquarium. The specifications of the manufacturer of the respective test or care product and the assessment of a qualified person are authoritative.

2.7 Handling of products and equipment. The App does not provide safety or handling instructions for water treatment and care products, chemicals, or aquarium equipment. Storage, dosing, and application are governed exclusively by the specifications of the respective manufacturer, in particular the instructions for use, warnings, and safety data sheet. This applies in particular to substances and devices whose improper use may endanger the health of humans or animals — such as ozone generators, acids and alkalis, disinfectants and medicinal products, and electrical devices operated in water.

2.8 Preview and test versions. The provider may make the App as a whole or individual functions available as a preview version, for example as part of a closed or open test via the respective app store. Preview versions serve the purpose of testing and further development. They may contain errors, be incomplete, change without notice, or be temporarily unavailable; individual functions may be removed again. Data may be lost. The user keeps an additional record, outside the App, of any information they rely on. The provider may end a test at any time and revoke the participation of individual users without stating reasons; content already created is retained in accordance with Section 5.5 as long as the account continues to exist. Sections 2.3 to 2.7 and 12 also apply to preview versions.

3. Conclusion of contract, registration, and anonymous use

3.1 By first using the App and confirming these Terms of Service, a free usage contract for the basic functions is concluded between the user and the provider.

3.2 The App may initially be used anonymously without providing personal login data; these Terms of Service also apply in that case. A user account is required for extended functions (e.g. cross-device use, shared aquariums). An anonymously used account may be deleted automatically after a longer period of non-use in accordance with Section 14.5; users who want to keep their data permanently secure their account with a sign-in.

3.3 The user is responsible for keeping their access credentials confidential.

3.4 Availability by country: The App is offered only in the countries in which it is available in the respective app store. Use from countries or territories in which the App is not offered, or whose residents may not be supplied under applicable sanctions or embargo regulations, is not permitted. The AI-based functions require that the AI service providers used offer their services in the respective country; they may therefore be restricted or unavailable in individual countries.

3.5 Conclusion of contract in the App: Before the contract is concluded, the App displays links to these Terms of Service and to the Privacy Policy through which the user can open both texts. The user submits their contractual declaration by ticking the box confirming these Terms of Service and then tapping the button to continue. Until then, they can untick the box at any time or cancel the process by closing the App; no further input is required to conclude the contract. The provider stores which version the user confirmed and when. The currently applicable version can be accessed in the App and at turq.app, where it can be saved or printed; the provider makes a previously confirmed version available on request. The contract can be concluded in German, English, Spanish, French, or Japanese. There are no codes of conduct to which the provider has submitted. The procedures of the respective app store apply to purchases (Section 6).

4. Minimum age

4.1 The App may only be used by persons who are at least 18 years old and have full legal capacity under the law of their state of residence. The App is not directed at minors.

4.2 By confirming these Terms of Service, the user warrants that they meet the requirements of Section 4.1.

4.3 The provider does not require proof of age and does not collect a date of birth. If the operating system or the app store transmits age information to the provider on the basis of statutory requirements (e.g. an age range), the provider uses it exclusively to enforce this Section. If it identifies the user as a minor, the App is not available.

4.4 Where there are concrete indications that the requirements of Section 4.1 are not met, the provider may block access pending clarification and terminate the account in accordance with Section 14; Section 10.10 applies accordingly.

5. Usage tiers, credits, and paid functions

5.1 The App provides functions in different tiers (e.g. a free tier and a paid "Pro" tier). For conversations with the AI assistant Qualy, a usage-dependent quota ("Qualy credits") is available, the scope of which depends on the respective tier. Consumption is measured by the actual size of each request and of the response generated for it; no specific number of requests is therefore promised. Other functions — in particular the detailed analysis of water parameters and the import of measurement data from uploaded files — have their own quotas, measured by count, and do not consume Qualy credits. Further functions may be subject to quantitative limits (e.g. number of aquariums, storage space for photos). The scope available per tier and your own consumption are shown in the App. Monthly quotas are provided anew at the start of each calendar month; unused portions expire and are not carried over. Quotas granted on a one-time basis do not renew.

5.2 The provider may adjust the scope of the quotas and their allocation per tier for the reasons stated in Section 2.2. Paid services already purchased for the current billing period remain unaffected. The provider informs the user of any reduction of a paid tier's quota, or of any other not merely insignificant impairment of a paid tier, at least 30 days before it takes effect, by email to the address on file; the change takes effect no earlier than the start of the following billing period, so that the user can cancel their subscription via the app store beforehand (Section 6.2). The notice draws attention to this and to the right to terminate the contract free of charge within 30 days under Section 327r(3) BGB.

5.3 The provider may grant one-time or time-limited free additional quotas (e.g. on the occasion of securing an initially anonymously used account through registration). Such bonuses are granted voluntarily, do not establish any entitlement for the future, and may be adjusted or discontinued. Their scope and conditions are as indicated in the App at the relevant time.

5.4 The provider may offer time-limited, free access to the functions of a paid tier (trial access, for example for testing purposes or as part of a test programme). During trial access, the user is deemed a paying user within the meaning of Sections 5.5 and 9.3. Such access is voluntary, does not require payment data, and does not automatically convert into a paid subscription. It ends automatically upon expiry of the period indicated in the App, without any need for cancellation. The provider may end it early if the user violates these Terms of Service or if the programme under which it was granted ends; Section 5.5 then applies accordingly. There is no entitlement to the grant, extension, or repetition of such access. Introductory or trial offers that the respective app store displays for a subscription (e.g. a discounted or free introductory period) do not constitute trial access within the meaning of this Section; they are governed by the terms displayed in the store, including any renewal specified there.

5.5 If a paid subscription or trial access (Section 5.4) ends, or if the user switches to a tier with a smaller scope, the functions exceeding the tier that now applies are no longer available. Content already created is retained; Section 9.3 applies to conversations with the AI assistant. If its scope exceeds that of the tier that now applies (e.g. more aquariums than that tier provides), the content exceeding that scope can only be read, not edited (read-only); it is not deleted. Editing becomes possible again by upgrading anew. The App indicates which content is read-only. If the storage space used exceeds the quota of the tier that now applies, existing files remain accessible; new uploads become possible again once the storage space used has fallen below the quota. Deleting your own content remains possible in every case.

6. Purchases and billing via the app stores

6.1 Paid functions (e.g. "Pro") are purchased exclusively as an in-app purchase via the respective app store (Apple App Store, Google Play Store). The purchase and payment process is handled by the respective store operator; their terms additionally apply.

6.2 Billing, management, and cancellation of ongoing subscriptions take place via the user account with the respective app store. The provider has no direct access to payment data; RevenueCat, Inc. (USA) is used to manage entitlements.

6.3 The prices displayed in the store at the time of purchase apply. Price changes for ongoing subscriptions are implemented according to the rules of the respective store.

6.4 Relationship to the app store terms: The terms of the respective store operator apply to obtaining the App via an app store and to purchases. Where the App is obtained via the Apple App Store, the license to the App software is governed by Apple's standard license agreement (Licensed Application End User License Agreement); these Terms of Service govern the use of the App and the associated services. Apple and Google are not parties to these Terms of Service and are not responsible for the App, its content, its maintenance, or support.

6.5 Right to use the App: Insofar as Apple's license agreement does not apply to the App software under Section 6.4, the provider grants the user, for the duration of the usage contract, the simple, non-transferable, and non-sublicensable right to use the App as intended on end devices at their disposal. Rights that the law grants the user on a mandatory basis, in particular under Sections 69d and 69e of the German Copyright Act, remain unaffected.

7. Right of withdrawal

7.1 For paid digital content and services, consumers are generally entitled to a fourteen-day right of withdrawal (Section 312g BGB).

7.2 As processing takes place via the app stores, the exercise of the withdrawal or the refund is governed by the terms and procedures of the respective store (Apple/Google).

7.3 As purchase and provision take place exclusively via the app stores, any premature expiry of the right of withdrawal where performance begins before the end of the withdrawal period, and the obtaining of the consent required for this, are likewise governed by the purchase process of the respective store; no separate request is made within the App.

7.4 Instructions on withdrawal for the free usage contract: For consumers, the following instructions on withdrawal apply to the free usage contract (Section 3.1); Sections 7.1 to 7.3 apply to purchases via the app stores.

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract, i.e. the day on which you first confirmed these Terms of Service. To exercise the right of withdrawal, you must inform us (Tim Gröschke, Berolinastr. 6, 10178 Berlin, Germany, email: support@turq.app) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form in Section 7.5, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, it ends. As you have not paid any fee for the free use, there is nothing to reimburse, and you will not incur any costs as a result of the withdrawal. We delete your account and your personal data in accordance with the Privacy Policy; your contributions to shared aquariums of other users remain there in accordance with Section 10.4. At your request, we will make your content available to you beforehand, free of charge, within a reasonable period, and in a common, machine-readable format; ideally, let us know this together with your withdrawal.

Independently of the right of withdrawal, you can end the usage contract at any time by deleting your account in the App (Section 14.1).

7.5 Model withdrawal form: Complete and return this form only if you wish to withdraw from the contract.

(¹) Delete as appropriate.

8. User obligations

8.1 The user undertakes not to misuse the App, in particular not to:

8.2 API and API keys: Where the tier booked by the user includes this (as indicated in the App), the provider offers an API through which systems connected by the user (e.g. smart-home integrations) can transmit data on the user's behalf. API keys are access credentials within the meaning of Section 3.3: the user keeps them confidential and is responsible for actions performed via their keys insofar as the user is answerable for them. In the event of misuse, security risks, or excessive load, the provider may block individual keys; use may be limited in volume (rate limits).

9. AI assistant "Qualy"

9.1 The AI assistant generates responses automatically. It is geared towards fishkeeping and related topics of animal care; it is not intended to provide information on other topics, in particular on human health. Responses may be incomplete or incorrect. Section 2.3 applies.

9.2 To provide the AI-based functions, inputs and the context required in each case are transmitted to an AI service provider (Google or OpenAI; see Privacy Policy). The provider determines which service provider is used for which function and may change this. Before an AI-based function is used for the first time, the App informs the user about the transmission; if the user declines, the AI-based functions are not available, while the other functions remain usable. The user should not enter sensitive personal data of third parties into the chat. The AI service providers apply their own automated safety filters to inputs and outputs; individual requests may therefore remain unanswered.

9.3 Retention of conversations: The user can delete conversations with the AI assistant at any time. In the free tier (including anonymous use), conversations are deleted automatically no later than 90 days after the most recent message. With active paid access of any tier, including trial access under Section 5.4, no automatic deletion takes place; if the paid access ends, the 90-day rule applies again. The user is responsible for backing up any content they need in good time. The provider does not routinely access conversations; the Privacy Policy sets out when access takes place (Section 5.11).

9.4 No safety or handling instructions. Statements by the AI assistant regarding products, chemicals, or equipment do not replace the manufacturer's specifications; Section 2.7 applies accordingly. For substances and devices whose improper use may endanger health, the manufacturer's safety data sheet and instructions for use are authoritative before any action is taken.

10. User content, shared aquariums, and reports

10.1 Content submitted by the user (e.g. notes, photos, measurements) remains attributed to the user. The user grants the provider the simple right of use required to provide the services (e.g. storage, display, cross-device synchronization, sharing with persons authorized by the user).

10.2 The user is responsible for holding the necessary rights to the content submitted. This applies in particular when submitting data or photos to a shared aquarium that other users can access.

10.3 Shared aquariums: The user can invite other users to an aquarium via invitation links. Members of a shared aquarium can view and edit its content (including changing and deleting individual items); deleting the entire aquarium remains reserved to the owner. The exact scope of functions depends on the version provided (Section 2.2).

10.4 Anyone passing on an invitation link grants the recipients the aforementioned access; public distribution of invitation links is not permitted. Members can leave a shared aquarium at any time. The owner can remove members from their aquarium; a removed member can only rejoin the aquarium once the owner allows it, and the invitation links they created for this aquarium become invalid. In both cases, the content contributed by the member remains in the owner's aquarium until the owner deletes it or the aquarium; by submitting content, the member grants the owner and the other members the simple right to continue using this content within the aquarium, including after the member has left or their account has been deleted. Content contributed by members counts towards the owner's quotas — in particular, uploaded photos count towards the owner's storage quota; owners should take this into account when choosing whom to invite. If the owner deletes the aquarium or their account, the content contributed by members to that aquarium is deleted as well (see Privacy Policy).

10.5 The number of owned and joined aquariums may be limited per usage tier (Section 5).

10.6 Prohibited content: Which content is prohibited follows from Section 8.1. The provider does not generally monitor users' content and does not actively search for legal violations; it takes action upon reports or when it otherwise becomes aware of such content.

10.7 Reports: Any person can report content that they consider unlawful or incompatible with these Terms of Service — in the App via the reporting function, where available, or by email to support@turq.app. The report should contain: an explanation of why the content is unlawful or prohibited; as precise an indication as possible of where it is located (e.g. aquarium, entry, or photo); the name and email address of the reporting person, unless the report concerns criminal offences against children; and a statement that the information is accurate and complete to the best of their knowledge. In the same way, users can report individual outputs of the AI-based functions that they consider offensive, harmful, or incorrect; they can include the relevant excerpt of the conversation. The provider acknowledges receipt, reviews the report in a timely, diligent, and objective manner, and informs the reporting person of its decision.

10.8 Review: The provider reviews and decides on reports without automated decision-making. The automated safety filters of the AI service providers (Section 9.2), which only concern inputs and outputs of the AI-based functions, are to be distinguished from the decision on reported content.

10.9 Measures: If content is unlawful or prohibited under Section 8.1, the provider may remove or block it, restrict access to a shared aquarium, deactivate invitation links, remove members from a shared aquarium, restrict individual functions, temporarily suspend the account, or terminate the contract in accordance with Section 14. In doing so, it takes into account the severity, frequency, and consequences of the violation, any fault, and the legitimate interests and fundamental rights of all parties involved; it chooses the least restrictive suitable measure.

10.10 Statement of reasons and objections: If the provider restricts a user's content or account, it informs the person concerned no later than when the measure takes effect, with a clear statement of reasons: the type, scope, and duration of the measure, the underlying facts, whether automated means were used, the legal or contractual basis, and the options for challenging it. Objections to a decision — including to the rejection of a report — can be raised by email to support@turq.app; the provider then reviews the decision again. Recourse to the ordinary courts remains unaffected.

10.11 Criminal offences: If the provider becomes aware of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of a person, it informs the competent law enforcement or judicial authorities.

10.12 Feedback: The provider may use suggestions for improvement, bug reports, and other feedback on the App for the further development of the App without compensation and without naming the user. Any personal data contained therein is processed by the provider in accordance with the Privacy Policy.

11. Availability and changes

11.1 The provider endeavors to ensure high availability but does not owe uninterrupted availability. Maintenance, disruptions, or force majeure may lead to restrictions.

11.2 Section 2.2 applies to the further development, change, or discontinuation of individual features; Section 14.8 applies to the discontinuation of the App as a whole.

11.3 Reminders and notifications. Reminders are delivered via the operating system of the end device and via third-party services. Their delivery may be delayed or fail to occur, for example due to device settings, power-saving features, or disruptions. The user must not rely on receiving a reminder; they are themselves responsible for time-critical maintenance measures.

12. Liability

12.1 The provider is liable without limitation in cases of intent and gross negligence, for injury to life, body, or health, for fraudulent concealment of a defect, and to the extent of a guarantee it has expressly assumed.

12.2 In cases of simple negligence, the provider is only liable for the breach of a material contractual obligation, i.e. an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance the user may regularly rely; in that case, liability is limited to the foreseeable damage typical of the contract.

12.3 Otherwise, liability is excluded. Mandatory statutory provisions (in particular under the German Product Liability Act) and mandatory consumer protection provisions of the state in which the user has their habitual residence (such as statutory consumer guarantees) remain unaffected.

12.4 The provider does not owe a professionally accurate assessment of the aquarium's condition and does not owe monitoring of the aquarium (Sections 2.3 to 2.7). For damage arising from displayed values, reference values, evaluations, calculations, or suggestions being acted upon without verification, the provider is liable in accordance with Sections 12.1 to 12.3 and 12.5.

12.5 Insofar as the user uses the App free of charge, the provider is not liable for simple negligence, notwithstanding Section 12.2. Sections 12.1 and 12.3 remain unaffected.

13. Changes to these Terms of Service

13.1 The provider may amend these Terms of Service. The App shows the user any changes not covered by Section 13.2 before they take effect and, where an email address is on file, the provider additionally notifies the user of them by email; continued use requires renewed confirmation of the amended version. If the user rejects the amended version, they cannot continue to use the App; they may delete their account at any time (Section 14.1) and, before doing so, obtain a copy of their content in accordance with the Privacy Policy. Section 13.3 applies to users with an ongoing paid subscription.

13.2 Purely editorial changes that do not affect the substance of the provisions, as well as changes that operate exclusively to the user's benefit, may be made without renewed confirmation.

13.3 If a user with an ongoing paid subscription rejects the amended version, they may continue to use the App under the previous terms until the end of the billing period already paid for; after that, continued use requires confirmation of the amended version. The user cancels the subscription in the subscription management of the respective app store; the App points this out. If the subscription nevertheless renews without the user having confirmed the amended version, the provider refunds the fee for the period during which the App could not be used.

14. Term, termination, and account deletion

14.1 The free usage contract may be terminated at any time by deleting the account or uninstalling the App.

14.2 Paid subscriptions are managed and cancelled via the respective app store.

14.3 After account deletion, personal data is deleted in accordance with the Privacy Policy. Certain records (e.g. of consents given) may be retained for a limited period to safeguard legitimate interests.

14.4 Unconfirmed email addresses: If an email address provided when registering with an email address and password or when securing an anonymous account is not confirmed within 30 days, the provider may automatically delete an account without content of its own, including the associated data; the provider continues an account with content of its own without the email address as an anonymous account (Section 3.2). The period starts with the registration or, if later, with the first confirmation email to the address provided; an address corrected before confirmation restarts it. Section 14.5 applies to anonymous accounts.

14.5 Guest accounts: The provider may automatically delete an anonymously used account (Section 3.2) that has not been secured with a sign-in, including the associated data, if it has not been used online for 90 days and contains no content of the user's own, or has not been used online for 180 days and contains content of the user's own (e.g. an aquarium created by the user, entries, photos, or Qualy conversations). Any use of the App with an internet connection counts as use; purely offline use does not count. Content of the user's own is data created or changed by the user, including photos, imports, and conversations with the AI assistant; the sample aquarium created at start-up counts only if the user has changed it. The periods start no earlier than the entry into force of the version of these Terms of Service dated 4 October 2026, which introduced this rule. Accounts linked to a purchase or another service (e.g. with a purchase, trial access, an API key, or a credit) are excluded. The free usage contract ends with the deletion. The deletion is also described in the Privacy Policy (Section 12.9). The user can avoid the deletion at any time by securing the account with a sign-in.

14.6 Accounts not used for a long time: The provider may delete an account secured with a sign-in (email address and password, Google or Apple login) that has not been used online for 24 months, including the associated data; this ends the free usage contract. Beforehand, the provider notifies the user of the upcoming deletion by email to the address on file, the first time no later than 30 days in advance. If the user uses the App with an internet connection before then, the deletion does not take place. Excluded are accounts with an ongoing paid subscription and accounts whose holder owns a shared aquarium in which other members have used the App during this period. The period starts no earlier than the entry into force of the version of these Terms of Service dated 4 October 2026, which introduced this rule. The deletion is also described in the Privacy Policy (Section 12.10).

14.7 Termination by the provider: The provider may terminate the free usage contract with one month's notice. Notice of termination is given in the App and, where an email address is on file, additionally by email. Until the termination takes effect, the user can continue to access their content. For good cause, in particular in the event of serious or repeated violations of Sections 4 or 8, the provider may terminate the contract without notice and block the account; Sections 10.9 and 10.10 apply accordingly. An ongoing paid subscription remains usable until the end of the period already paid for, unless the reason for termination lies in a violation by the user. As the provider cannot end subscriptions via the app store, it advises the user in the notice of termination to cancel the subscription themselves in the app store (Section 6.2).

14.8 Discontinuation of the App: The provider may discontinue the App as a whole. It announces this at least one month in advance in the App and, where an email address is on file, by email. The usage contract ends upon discontinuation. Until then, the user can continue to access their content; on request, the provider makes a copy of their content available to them in a common, machine-readable format. The provider ceases to offer paid subscriptions before the discontinuation and advises users to cancel them in the app store; the provider refunds fees already paid for a period after the discontinuation on a pro rata basis, on request also directly insofar as a refund via the respective app store is not possible. After the discontinuation, user data is deleted in accordance with the Privacy Policy.

15. Final provisions

15.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the user has their habitual residence remain unaffected.

15.2 The place of jurisdiction is the provider's registered seat (Berlin), insofar as the user is a merchant, a legal entity under public law, or a special fund under public law, or has no general place of jurisdiction in Germany. Statutory places of jurisdiction apply to consumers.

15.3 Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.

15.4 The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
